How to protect myself from a general contractor performing home remodeling? I am about to have a general contractor perform services for me (tile in kitchen, wood flooring, wallpaper removal). He told me that there is no contract to sign, and that we both can sign the proposal he has given me to act as a contract. I trust the guy, as a trustworthy friend of mine recommended him, but what do I need to do to protect myself? Is there a simple contract I can draw up to ask him to sign? Where can I find it? What can I do when I find out my general contractor inflated our construction bill and get him liable for job. We are building our house for past 1 year. Recently, we compare the building details with other friend and realized the general Contractor inflated our rough lumber bill over about 80000(same as other items). Even though on our contract we agree to pay him such amount, we felt that we were cheated when he presented the contract with us. There are several defects on materials or installation such as doors and windows in my new house (such as the casement windows can't be close during the hot day, the 2-piece front door can't be closed tightly). My contractor refused to take responsiblity of it. Can anyone know what I can do to get the contractor be liable for it?
Can someone give me some advice on a General Contractor who refuses to pay for work already completed? Im in california and did some work for a general contractor.three months after work has been done hes refusing to pay what we agreed on, and wants to bargain with me on the price that was already agreed on .7 other people are going thru the same with him. What percentage should a developer receive for a new building if he doesn't act as the general contractor? I am a physician who is going to build a new medical office. I have someone who is a developer helping coordinate the permit process, overseeing the engineering and architecture and possibly bring a partner to the deal. He hasn't put out any money and won't act as the general contractor but thinks he deserves 1/3 of the project. He will assume part of the mortage risk but won't have an office in the building and therefore won't be paying rent. I think he wants way too much but I have never worked with a developer before. Help!

Exploring Options for uising a General Contractor for a kitchen remodel? We are considering a kitchen remodel. We've hired a general contractor and a kitchen designer for the DESIGN PHASE (a seperate agreement will be presented for the BUILD PHASE). We would like to explore other paths in lieu of hiring a GC. We are interested in hearing from homeowners who have done kitchen remodels as to the options they pursued? How many served as their own GC's? How did that go? How many worked with the local home center for cabinets, floors, etc and left the structural stuff to someone else? How did that work? We're not interested in being our own GC, but there has got to be a less expensive way! We're making quality decisions and downgrading OUR choices for OUR kitchen just to pay the GC's fee and overhead costs. For example, we did all the work to select over $10K worth of appliances (which will be delivered and installed) and the GC will stand to earn quite a bit for what appears little work (enough for another appliance). Are there any other options?
Can anyone recommend a good general contractor in Los Angeles? My honey and I want to add a 500 sq. ft. addition to our home. Flat lot, nothing fancy (one room, one bathroom), so it should be simple, right -- wrong! Many of the contractors we have spoken with are too expensive (one said it would be a minimum of $500k) or too arrogant (seriously - how hard is it to return phone calls!) or are not interested in jobs that small. Please only recommend someone that you hired and loved. I already have a vast collection of contractor horror stories from friends.

Should I hire a general contractor for my second flip? On my first flip my general contractor was a disaster. It seems to me that there whole job is hiring sub contractors and charging me for making the call. I have the time to be at the job to make sure things are being done. I want to make this my career. Can a homeowner put a lien on General Contractor for unpaid refund? We hired a lawyer & fired our General Contractor (GC) - breached EVERY breach provision in our contract. Being ignorant, we gave GC 10% deposit for all categories to build a new home & 90+% on some jobs that are <60% complete. We requested partial refunds for payments on botched jobs that failed inspection and 10% deposits made for work that NEVER commenced (dry wall, Hvac, etc). GC refused to pay - stated he rather go to jail & send his family to Taiwan. Our attorney suspects money is being wired overseas and GC is ready to bail America so contingency fee not acceptable to our attorney. We filed complaint with CA License board. We want GC license revoke to avoid more victims of his prey. Do we have any legal claim to lien against GC home/bank? We discovered many subs unlicensed, GC never was on site to oversee job & subs still due money. Supply vendors unpaid & we fear liens will surface. Dream home has become a nightmare.

Is this Legal? Principal sidesteps General Contractor on project extension - goes directly to SubContractors.? A general contractor is hired by a principal to erect an large art exhibit. The gen'l contr. hires subcontractors to build the exhibit and acquire rented and loaned items. The gen'l contractor is paid an override from the principal on what is charged by the subcontr. to do the work. The principal paid the gen'l cont. and then the gen'l paid the subcont.. The principal then decides to extend the display period beyond what was originally contracted for with the gen'l, but does so w/out going through the gen'l. The principal goes DIRECTLY to the subcont. doing an "end run" around the gen'l. contr. If the gen'l would have known the display period would have included this additional time, the original cost to the principal would have been greater thus allowing the gen'l a larger fee. Does the gen'l have a cause of action against the principal for the lost fee? Is there case law to support the gen'l's claim?
How long is my general Contractor liable for his work? 3 years ago we purchased a newly built house by a private contractor. Recently we noticed the roof was leaking. The cause of the leak was a improperly installed/missing flashing, which lead to major water damage behind the wall and fungus growing out of the carpet. The contractor subbed the roof out to roofers who were a) not liscenced and b) are no longer in business. We want the GC to pay for the repair, he refuses...is he liable for the repair?
in a construction loan does the buyer and the general contractor? have to sign on all draws? Does the buyer have rights to know for what and how much material,Etc, costs on an ongoing basis thru the whole process. My brother in law is the contractor and is taking draws out and we haven't approved anything and how could the bank approve it without our signature? In law says the doesn't have to show him receipts since we signed a contract with him.. I just found out on internet that there is a construction loan sworn statement for. We never heard of this and know that we didn't sign one. Should we have gotten one? Could he possibly not be a licensed contractor. Sure would appreciate some input.
Question about General Contractor and concerns.? I hired a a general contractor to add a room to my house. We signed a contract for plans and permits. Now they tell me that permits cost more than they had anticipated and are asking for the difference (2000.00). It seems to me that they should have known how much permit fees are for such a project. Am I wrong? Also, there were lots of changes made by the city (which added to the project price a significant amount over 10,000 dollars), which makes me wonder if they really understood the scope of the work to be performed. I am worried because we are getting ready to sign the contract for the actual work. Any suggestions or feedback would be greatly appreciated.
