- Often, an independent contractor is bound by a signed agreement for legal and tax purposes. That contract would have to be amended or supplanted. Also, IRS filings would have to change. If there is no contract, then a standard hiring procedure should suffice (as long as the potential employee is not contracted by another organization, such as a temp firm). Check with your state's Dept of Labor or a labor attorney if you're not sure of the laws in your state.
