Would they be an independent contractor or an employee?

Prudence contracted C&N to build her a house, who then assigned the job to to Shacks-4-U. Prudence was not informed of the change, and didn't notice the new names on the bills, continuing to send payments to C&N. When there was a breach of contract, C&N said they have no liability due to the effective assignment to Shacks-4-U. So, is Shacks an employee, or independent contractor? This will help me determine if C&N can still be help liable? Or could it be that C&N simply assigned duties to Shacks?

  1. Both C&N as well as Shacks-4-U would be considered "independent contractors" Prudence "contracted" the work to C&N... C&N then "subcontracted" the work to Shacks-4-U... If Prudence has any issues, they should be directed to C&N, as that is who was hired by Prudence. C&N if needed, then has to handle the issue with Shacks-4-U as it was C&N whom subcontracted them. Long story short... if Prudence has an issue... then it is C&N's responsibility to correct said issue. - Good Luck!
